DAYTONA BEACH, FL - Nearly three years after the fact, Wall Section #277 of the Daytona International Speedway is still waging a heated financial court battle with the Earnhardt Estate and several of its merchandising distributors.
Since the death of Dale Earnhardt, Sr. at the Daytona 500 in February 2001, fans have been treated to a huge increase in Dale Earnhardt t-shirts, air fresheners, cough drops, the Dale Earnhardt Tabletop Spice Caddy™, and Blue Earnhardt™ (a new color available at all Sherwin Williams locations). Also, February 2004 will mark the grand opening of the Dale Earnhardt Wal-Mart in his hometown of Kannapolis, North Carolina.
While the Earnhardt family could not be reached for comment, Section #277 told reporters, "It's like I'm saying. Everybody is making money off of Dale's death except for me: the guy that killed him. It just doesn't seem fair."
If #277 wins his case, he's hoping to develop his own merchandise, including Daytona 500 Wall-Flavored Cereal™ and a "Wall Gray" clothing line for GAP stores. It's also rumored that #277 has completed the script for an autobiographical segment for the third installment of HBO's award winning series If These Walls Could Talk.
